Your role and responsibilities
The Business Area Senior Counsel for ABAC and Trade will involve providing leadership, direction, and oversight for the Legal & Integrity organization over these topics and coordination with the functional and business stakeholders to ensure ABB Electrification meets its legal obligations across these substantive areas and that it designs, implements, and maintains a fit-for-purpose corresponding integrity program.
The role will oversee the implementation of Corporate Regulations on international export control, sanctions, customs, ABAC compliance, and recommend and draft necessary policy updates for the BA.
The senior counsel will provide both general and transaction-specific trade and ABAC compliance guidance to the Legal and Integrity team and other company managers, including on complex export control and sanctions questions, and coordinate with the Group as required.
The role will involve interacting with and providing senior leaders with risk assessments regarding geopolitical influences on business import and export strategies in coordination with the HOI and BA GC and will involve leading on behalf of the BA, sector, or country-specific task forces to monitor, guide, and manage activities in sanctioned sectors or countries.
The senior counsel will assist, coordinate, and/or oversee the interaction with government authorities in relation to sanctions, licensing, anti-dumping, and ABAC issues, including the Deferred Prosecution Agreement leveraging past enforcement exposure, with the Group as needed.
The senior counsel will provide guidance across the BA and support in the assessment and execution of anti-dumping measures and ABAC controls.
The senior counsel will oversee the training of relevant business personnel and oversee their work as needed.
The senior counsel will provide both general, investigation, and transaction-specific Trade and ABAC risk mitigation guidance to Legal & Integrity colleagues in the context of normal business operations.
The role will involve managing a team of SMEs that will be responsible for reviewing the output of the due diligence being performed as part of the TPM Sell process and coordinating with the relevant division to mitigate and address the risks as needed.
Qualifications for the role
* Master's degree in Law or equivalent
* 10+ years of trade and ABAC related compliance experience, including (a) effective decision-making at a senior corporate level, (b) demonstrated management, organizational, and communications abilities, and (c) a clear understanding of underlying issues relating to international relations and global trade and ABAC compliance.
* In-depth knowledge of government regulatory processes, position-specific legal requirements (export control, sanctions, customs, etc.), and compliance best practices.
* Knowledge of the international marketplace, international politics, and global trade, AML, and sustainability compliance goals and programs.
* Familiarity with commercial issues and product offerings for industries related to ABB’s global trade.
* In-depth knowledge of regulatory policies regarding compliance-related product/technology classifications.
* Proven ability for complex decision making.
* Leadership ability, credibility, networking skills, and responsiveness to requests for assistance.
* High-level communication skills relating to management processes and complex regulatory requirements.
