The mission of the role will be to safeguard and enhance the intellectual property assets of MKS PAMP Group, aligning comprehensive IP strategies with corporate and product visions. The incumbent will manage and expand our trademark and domain name portfolios, ensure compliance with global legal standards, and aggressively combat counterfeiting. Through close collaboration with internal teams and strategic use of resources, the incumbent will strive to protect our brand's integrity and foster its growth in the marketplace.
MAIN ACTIVITIES AND RESPONSIBILITIES
1. Develop a comprehensive IP protection strategy aligned with the overarching corporate and product (minting) strategies.
2. Ensure compliance of IP portfolios and trademark use with relevant laws and industry regulations.
3. Manage, structure and develop our trademark and domain name portfolios to strengthen our brands, including handling new registrations, renewals, defensive registrations, and conducting audits.
4. Develop IP licenses within the MKS PAMP Group and identify licensing opportunities.
5. Ensure proper trademark use within the company, gather and preserve evidence of trademark use. Collaborate with marketing and product teams to develop guidelines and enhance brand presence where needed through strong and robust IP support and defense mechanisms.
6. Monitor globally counterfeit sales, online and offline, develop and implement a counterfeit combating strategy, including registration of trademarks with customs.
7. Draft and review warning letters, settlement agreements, oppositions, and cancellation actions.
8. Handle pre-litigation and litigation disputes (including UDRP and local ADR complaints), with external counsels when necessary, for any necessary IP legal action.
9. Collaborate with IT and third-party suppliers to improve IP and counterfeiting monitoring and analytics tools.
10. Monitor and manage the IP budget to ensure it stays within limits and achieves effective cost outcomes.
REQUIRED EDUCATION AND EXPERIENCE
1. Master's degree in Law or related field.
2. Certification in Intellectual Property.
3. Minimum 5 years of experience in IP Law, with a focus on trademarks, design, and domain names.
4. Proven experience working with international clients and managing cross-border IP issues.
5. Proven track record in managing international IP portfolios and handling complex legal disputes as an in-house counsel.
